Terms & Conditions of Use

PREAMBLE

These Terms & Conditions ("T&C") apply to all sales transactions between Phone Option and its customers on the official Phone Option website.

DEFINITIONS

• Website: The official Phone Option online store where products are displayed and sold.
• Customer: Any individual or entity purchasing from Phone Option.
• Order: The legally binding agreement between Phone Option and the Customer.
• Products: All items, including spare parts, available for purchase on the website.
• Transaction: Secure processing, authorization, and completion of payment for an Order.

1. ACCEPTANCE OF TERMS

By placing an order, the Customer acknowledges having read and fully accepted these T&C without reservation.

2. PRODUCTS

Phone Option offers various products, most of which are available for immediate purchase. However, some items may not always be available for online sale.

3. ORDER & PAYMENT

• Orders are confirmed upon email confirmation from Phone Option.
• Phone Option reserves the right to refuse or cancel an order due to payment failure, fraud suspicion, or previous order disputes.
• Orders must be paid in full at checkout using the available payment methods.
• Phone Option is not responsible for errors in Customer-provided details, such as incorrect shipping addresses.

4. DELIVERY & SHIPPING

• Products are shipped within 24 hours if in stock.
• Estimated delivery time: 48-72 hours after shipment.
• Delivery delays of more than 7 days entitle the Customer to cancel the order, except in force majeure cases.
• Claims for missing or damaged items must be submitted within 48 hours of receipt.

5. RETURN & REFUND POLICY

• Right of Withdrawal: Customers have 14 days from delivery to return unused items for a refund.
• Return Conditions: Products must be unused, in original packaging, and include all accessories and manuals.
• Refund Process: Refunds are processed within 7 days after receiving the returned product.
• Return Shipping Costs: Customers are responsible for return shipping costs unless Phone Option made an error.

6. WARRANTY POLICY

• Spare parts are covered for 2 years only if they remain unused and uninstalled.
• Installed spare parts are no longer eligible for warranty claims due to their fragile nature.
• Phone Option is not responsible for improper handling that causes breakage or damage.

7. PRICING & TAXES

• Prices are listed in EUR (€) and include applicable VAT.
• Shipping fees are not included in the product price and are calculated at checkout.

8. LIABILITY DISCLAIMER

• Phone Option is not liable for accidental damage, improper product use, or indirect damages.
• Phone Option is not responsible for third-party website links or external content.
• Phone Option's liability is limited to the total amount of the customer's order.

9. DATA PRIVACY & PROTECTION

• Customer data is processed in compliance with our Privacy Policy.
• Customers have the right to access, correct, or delete their personal data upon request.

10. DISPUTES & GOVERNING LAW

• These T&C are governed by the laws of Malta.
• Any legal disputes must be resolved in Maltese courts.
• Before legal action, both parties agree to seek an amicable resolution.
